Most people who have heard of the EB-5 investor green card know two things about it: it requires a large investment, and it requires creating ten jobs. The first is true. The second - for passive investors — is where the popular understanding goes wrong.
Through the EB-5 Regional Center Program, you can invest in a third-party U.S. project, let professional developers do the work of building and hiring, and receive a green card for yourself and your family. You never manage anything. You never hire anyone directly. Here is how it works.

What Is the EB-5 Passive Investment?

Starting at $800,000, the Regional Center route allows you to invest in a qualifying third-party U.S. project – the construction of a new hotel, for example – rather than running your own company. Based on that investment, you apply for a conditional green card, and in well-prepared cases the conditional approval can come remarkably quickly – in our experience, in as little as roughly 90 to 120 days for certain fast-tracked filings.

After two years, your attorneys demonstrate to USCIS that the investment complied with EB-5 requirements – at which point the conditions are removed and your green card becomes permanent.

"But What About the Ten Jobs?"

This is the concern I hear most often, and it’s based on a misunderstanding. Yes, EB-5 requires that ten jobs be created. But in a Regional Center investment, the project creates those jobs -not you. The hotel under construction employs the workers; the economic model attributes the job creation to the pooled investment. As a passive investor, you do not hire anyone.

That is the entire point of the passive route: your capital works, and you live your life.

What Happens to Your Money

Your investment is placed with the project under defined terms, typically earning a return in the range of 3% to 6%, depending on the specific project – and some projects pay more. Under the program’s structure, invested capital is generally expected to be returned after the two-year sustainment period, and sometimes sooner, subject to the terms of the particular project.

Two structural protections matter here. First, Regional Centers are licensed by USCIS and carry both audit and fiduciary responsibilities in handling investor funds an additional layer of oversight that a private deal doesn’t have. Second, before you commit a dollar, the project itself should be evaluated on its merits: the developer’s track record, the capital structure, the exit strategy. Birg Law works alongside the financial advisors at Orbiter Partners™ to help clients find the right project and evaluate it thoroughly.

Why This Path Matters Most for Citizens of China and India

Here is the feature that makes EB-5 uniquely valuable: it is open to citizens of every country – including countries whose citizens face years-long waits in the employment-based green card categories.

For citizens of China and India especially, an $800,000 investment in a Targeted Employment Area (TEA) – typically a rural area or one with high unemployment – is processed on a fast-tracked, set-aside basis. Where an EB-2 or EB-3 petition might mean a decade of waiting, a TEA-based EB-5 investment can deliver a green card in a fraction of that time.

Projects outside a TEA require a minimum of $1,050,000, which is why nearly all of our passive-investment clients select TEA projects.

Your Family Is Included

Every EB-5 investor’s derivative family members – your spouse and unmarried children under 21 – receive green cards as well. Work authorization for the whole family can often be obtained even faster than the green card itself.

And the program is flexible about where you start from: those already in the U.S. in lawful status can adjust status without leaving; those abroad enter the U.S. once the conditional green card is approved; and in some cases, even individuals in immigration court proceedings may qualify for an EB-5-based green card – a possibility that surprises many people and deserves a careful case-by-case review.

A Quick Self-Check: Do You Qualify?

Three questions:

If you answered “yes,” you may qualify for an EB-5 visa and green card. Your current immigration posture – existing U.S. visas, any prior overstays, any removal proceedings – shapes the filing strategy, and we review all of it in the initial consultation.
  1. What country are you a citizen of? (Every nationality qualifies - this simply shapes your timeline and strategy.)
  2. Are you able to invest at least $800,000 into a third-party commercial enterprise, with separate funds to live on for two years?
  3. Can you demonstrate and document the lawful source of the invested funds? Importantly, the money can be earned, borrowed, gifted, or derived from the sale of property - the requirement is documentation, not any particular origin.

The Next Step
