Who Qualifies for a U Visa? The U visa is available to immigrants who meet the following criteria:

  1. You've been the victim of a qualifying criminal activity, such as:

  2. You've suffered substantial physical or mental abuse as a result of the criminal activity.

  3. You have information about the criminal activity and are willing to assist law enforcement or government officials in the investigation or prosecution of the crime.

  4. The criminal activity occurred in the United States or violated U.S. laws.

  5. You are admissible to the United States or eligible for a waiver of inadmissibility.

If you meet these requirements, the U visa can provide you with lawful immigration status in the U.S. for up to 4 years. After 3 years, you may even be able to apply for a green card and become a permanent resident.
